Through the effective use of competent attorneys, a trained paralegal and support staff, state-of-the-art computer technology and other resources we have been able to maximize our clients financial recoveries by the most efficient means possible. Our firm represents plaintiffs in a variety of personal injury cases ranging from auto accidents, wrongful death, premises liability, dog bites, and slip and falls. Many of our clients have had significant personal injury cases which resulted in substantial settlements and verdicts. Real Estate and Land Use Law: Modern real estate law is becoming increasingly
complex. The Law Offices of Brendan J. Kavanagh has
represented a broad spectrum of commercial, industrial, and residential
clients in all types of real estate matters. These clients include
buyers and sellers of real estate as well as building contractors and
developers. Experience and thorough preparation are the backbone
of any successful real estate transactions. Our office has both
the technical background and the practical experience to deliver top
quality legal services in this area. Our office will take an active
roll in every aspect of a real estate transaction from assisting with
contract negotiations and finance structuring to working with the lending
institution and the title company to conduct a smooth real estate closing. By providing our clients with a thorough analysis of all the legal issues affecting their transaction and offering our sound judgment and legal recommendations, our firm delivers the most efficient and cost effective legal representation available in the area of real estate law. Criminal Law/Traffic Court: The Law Offices of Brendan J. Kavanagh
has successfully represented numerous defendants in criminal cases involving
possession and distribution of CDS, kidnaping, burglary, sexual assault,
arson, and other high profile cases. In addition to indictable
offenses, our office has one of the most active municipal court practices
in South Jersey. These cases include DWI cases, driving with a
suspended or revoked license, theft, possession of marijuana, simple
assault and resisting arrest. Our attorneys are trained to conduct
in depth client interviews so as to ascertain all of the necessary facts
surrounding the criminal allegations. We have a deep understanding
of the client’s need to play an active roll in the progression of their
criminal charges through the court system. To satisfy this need
we regularly meet with our clients to review with them the status of
their cases including all of the evidence discovered through our investigation
and testimony from potential witnesses. Thereafter, we take our
clients step by step through the criminal court system. Our law office takes very seriously the concept
of “innocent until proving guilty beyond a reasonable doubt”.
This is the foundation of our criminal justice system. We zealously
defend our clients and protect their rights at any cost. We also believe that individuals are entitled
to a second chance in life once they have paid their debt to society.
To this end, we have successfully petitioned New Jersey courts for the
expungement of numerous clients’ criminal arrests and conviction records.
This very rewarding area of our practice assists our clients in obtaining
jobs for which they might not otherwise be qualified because of their
prior record. It also instills in them a renewed sense of integrity
and self confidence which ultimately results in them becoming more productive
citizens. Mr. Kavanagh has proudly served as the Municipal Public Defender for the City of Millville for the past seven years as well as the Municipal Public Defender for Maurice River Township. In addition, Mr. Kavanagh’s solid reputation in New Jersey Municipal Courts has earned him the respect of his peers and judges alike such that Mr. Kavanagh has been called upon on numerous occasions to act as a substitute prosecutor in various municipalities. This exposure to “both sides of defense” has greatly augmented Mr. Kavanagh’s substantive knowledge and litigation skills in this area of his practice. Wills and Estates: One of the most important legal documents one
can have prepared, but yet is so often overlooked and ignored, is a
Last Will and Testament. Regardless of your economic class, every
individual has an estate which should be properly transferred to the
individual’s heirs following their death. Indeed, it is
advantageous to both the individual and his or her surviving family
members or close friends that he or she execute a Will.
At the Law Offices of Brendan J. Kavanagh we frequently prepare
and/or modify Wills for our clients. We emphasize the importance
of avoiding family discord amongst our clients’ heirs as a result of
not planning ahead for the orderly transfer of property. We also
make certain that our clients give due consideration to naming an appropriate
guardian for their minor children. Without a Will your estate
may not be distributed as you intended, thus causing hardship for those
you want to protect most. In addition to preparing Last Will and Testaments,
the Law Offices of Brendan J. Kavanagh has also successfully
litigated the administration of estates on behalf of both opponents
and proponents of a Will. We have also been successful at litigating
Will contests at the Appellate Division level. Our solid reputation
in this area of the law has resulted in the attorneys in our office
being appointed by the court to represent the interests of minor children
and other unrepresented litigants whose rights need to be protected. Our office can also assist you in controlling
decisions about your own health care while you are of sound mind.
An Advanced Directive, or a “Living Will”, is a legal document which
clearly expresses the wishes of a competent adult with regards to the
termination of life sustaining medical treatment if and when the person’s
decision making ability has been lost or impaired due to a serious and
sudden illness or accident. Indeed, New Jersey recognizes the
right of competent adults to plan for their future health care needs
and to have their voluntary and informed wishes respected. In
addition to a Last Will and Testament, our office will cover in great
detail with our clients the benefits and limitations of a Living Will.
While the final decision to have a Living Will or not rests solely with
the client, we feel it is our responsibility to provide our clients
with the knowledge necessary to make such an important decision. Lastly, our firm regularly handles all types
of guardianships on behalf of clients whose loved ones are mentally
challenged or are otherwise incapable of managing their own personal
and financial affairs. These types of hearings, wherein we seek
to have the mentally challenged individual declared legally incompetent
and a family member named as their guardian, are very sensitive hearings
that require the personalized attention of a dignified law firm such
as the Law Offices of Brendan J. Kavanagh. Employment Discrimination: The Law Offices of Brendan J. Kavanagh represents
employees in actions against their employers and co-workers involving
claims of sexual harassment, hostile work environment, work place discrimination,
retaliation (“whistle blower”), and other claims of wrongful termination.
Fortunately, New Jersey is on the cutting edge with regards to employment
law statutes. Indeed, the New Jersey Law Against Discrimination
(“N.J.L.A.D.”) has served as a model for other state lawmakers when
drafting employment legislation. The N.J.L.A.D., the New Jersey
Family Leave Act and the New Jersey Conscientious Employee Protection
Act (“CEPA Statute”) are broader in scope than their Federal counterparts.
These laws prohibit employers from discriminating against individual
employees because of their sex, race, religion, age, or handicap.
The CEPA Statute also prohibits employers from retaliating against employees
who “blow the whistle” on employers whose activity they believe
to be illegal or contrary to public policy. The New Jersey Family Leave Act, as well as the Federal Family and Medical Leave Act, provide certain protections to employees who take time off from work due to the birth of a child, or an illness to themselves, a parent, spouse, or a child. The law provides specific rights with regards to the length of time a person takes a medical leave and demands that the person be returned to the same or equivalent position after the family leave time has expired. Our firm has diligently prosecuted many employment related matters for our clients. Due to our reputation for strong advocacy in this area, our law firm regularly receives employment law referrals from other law firms. In addition, we have been asked on many occasions to conduct internal investigations for both large and small corporations who have been accused of having hostile work environments or discriminating practices. Lastly, we have been called upon by both management and employees to give a thorough legal analysis with regards to corporate severance packages which usually include a Separation Agreement and Release, Secrecy and Invention Agreement, and Non-compete clauses. |
